Defending Your CFRA and FMLA Rights
Both the CFRA and FMLA allow eligible employees to take up to 12 weeks off from work in a given calendar year for the following reasons:
- The employee is unable to work due to a medical condition
- The employee needs to take care of an immediate family member with a serious health condition
- The employee needs time off for the birth or adoption of a child in the family
For a worker to be eligible for CFRA and FMLA leave, the following conditions must be met:
- Must have worked at the company for at least 12 months
- Must have worked at least 1250 hours during that time
- Employer must have at least 50 employees within a 75 mile radius; smaller companies are not held to the standards of the CFRA and FMLA
