A complaint was filed on behalf of Bank of the West's ("B of W") Customer Service Managers (“CSMs”) on April 22, 2008. The complaint alleges that CMSs are improperly classified as exempt
from overtime and that they regularly work more than eight (8) hours
per day or forty hours per week. This is an action for overtime, failure to provide meal and rest
periods, failure to itemize the total hours worked on wages statements furnished to CSMs and failure to keep payroll records showing the actual hours worked each day by CSMs. The lawsuit covers all former and current employees of B of W who worked in the position of CSM at any time between April 22, 2004 until the present.
